01The agreement

This is a draft, not legal advice. It was written to match how AMD Cop actually works and to cover what carriers and regulators in the UK, the US and Canada ask for. It has not been reviewed by a lawyer and is not in force. Have counsel qualified in each territory review it before you publish it or rely on it in a carrier application.

These terms are between you and DigiTalker Ltd, company number 16279329, registered at Unity House, Fletcher Street, Bolton, England, BL3 6NE. They govern your use of the AMD Cop website and software. By installing or using the software you accept them. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it.

02Licence

Subject to these terms, you may install and run AMD Cop on infrastructure you control, for as many calls and on as many servers as you wish.

To confirm before publication. The open-source licence has not been chosen. This section, the repository, and every "open source" statement on the site depend on that decision.

03Your data stays yours

We claim no ownership of your call recordings, dispositions, configuration or business data. In a self-managed deployment none of it reaches us.

You are the controller of the personal data your campaigns touch. Meeting your obligations to called parties is your responsibility, not ours.

04Your compliance obligations

AMD Cop decides whether a person or a recording answered. It does not make your dialling lawful. You remain responsible for:

United States

The Telephone Consumer Protection Act, including consent for automated and prerecorded calls, and honouring revocation and do-not-call requests promptly and in any event within 10 business days.
The FTC Telemarketing Sales Rule, including the 3% cap on abandoned calls.
STIR/SHAKEN attestation and Robocall Mitigation Database obligations, where they apply to you as a voice service provider.

United Kingdom

Ofcom's persistent misuse policy, including the limit on silent and abandoned calls.
The Privacy and Electronic Communications Regulations, including TPS and CTPS screening.

Canada

The CRTC Unsolicited Telecommunications Rules and the National DNCL.
CASL, where your campaigns include commercial electronic messages.

Nothing in the software, and nothing on this website, should be read as advice that a given campaign is lawful.

05Performance figures

Accuracy and latency figures published on this website are stated design targets, not measured benchmark results, and are labelled as such wherever they appear. They are not warranties, they are not representations of fitness, and they must not be relied on as evidence of compliance with any abandonment or silent-call limit.

Benchmark results, with methodology and the class balance of the evaluation set, will be published with the first general-availability release.

06Acceptable use

You may not use AMD Cop to place or facilitate calls that are unlawful in the territory they are placed to, to evade caller identification requirements, to defeat do-not-call registers, or to support fraud or harassment. See the acceptable use policy for the detail.

07Warranties and liability

The self-managed software is provided as is, without warranty of any kind, to the extent the law allows. Nothing excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

To complete before publication. Liability caps, indemnities, the support commitments attached to paid tiers, and governing law and jurisdiction all need drafting by counsel. They are the clauses most likely to be negotiated by an enterprise buyer.

08Changes

We may update these terms. Material changes will be posted here with a revised effective date, and where we have your contact details we will tell you.
